When support is overdue, the review checks:

Which installments go into the arrest request and which go to garnishment.
Whether the payer has formal employment, to request payroll deduction.

Overdue support
Pregnancy without support
The payer stopped paying and does not respond. The law allows collecting the last 3 installments with a request for arrest, and the rest through garnishment of salary and assets (CPC, art. 528).
A pregnant woman may request support during pregnancy. After the birth, it becomes child support until someone asks for a review (Law 11,804/2008).
The payer’s income dropped
The child turned 18
The payer lost their job or now earns less. A reduction can be requested in court (Civil Code, art. 1,699), without stopping payments in the meantime.
Support does not end automatically at 18. Ending it requires a court decision (STJ Precedent 358), and a child who is studying may keep receiving it, depending on the case.
How much is the support?
The law sets no percentage. The judge balances the needs of the recipient with the means of the payer (Civil Code, art. 1,694, § 1). For an idea, use our calculator.
Does someone without a formal job pay support?
Yes. When income is not proven, support is usually set as a percentage of the minimum wage, and signs of wealth can show the real income.
Does support apply to the 13th salary and vacation pay?
Yes, for those with formal employment or civil servants. The STJ held that the percentage applies to the 13th salary and the vacation bonus (Theme 192).
Can late support lead to arrest?
Yes, when the claim involves the last 3 installments before the action and those that fall due afterwards. Arrest lasts 1 to 3 months and does not erase the debt (CPC, art. 528).
Can grandparents be required to pay?
Only as a complement, when the parents cannot pay, in whole or in part (STJ Precedent 596).
I live in another city or abroad. How does it work?
Service is digital. Documents, meetings and signatures can be handled remotely.
Can old arrears still be collected?
Each installment expires 2 years after its due date, but the period does not run between parents and children during parental authority (Civil Code, arts. 197, II, and 206, § 2). That is why arrears owed to a minor child are usually collectable. The review confirms this in each case.
What is the “Pix pensão”?
It is the automatic transfer of support created by Law 15,479/2026, which takes effect one year after publication. Until then, arrest, garnishment and payroll deduction remain available.
