Name blacklisted without owing
Phantom payroll loan
Blacklisting for a non-existent debt, one already paid or resulting from fraud can be removed in court, and the courts recognize that damage to one's name, in itself, usually justifies compensation for moral damages, assessed case by case.
Loan deductions that the retiree never took out are a frequent fraud. You can request cancellation, a refund of what was deducted and, depending on the case, compensation, with the institution liable for the security failure.
Defect brushed off
A flight that became a nightmare
A defective product has short complaint deadlines (as a rule, 30 days for non-durable and 90 for durable goods), and if the repair takes more than 30 days the law lets the consumer choose a replacement, a refund or a price reduction.
Significant cancellations and delays create duties of assistance (communication, meals, lodging) and, when they cause losses, a right to a refund and compensation. Boarding passes, receipts for expenses and screenshots make the case.
My loss was small. Is it worth complaining?
Often, yes: beyond the amount itself, cases such as wrongful blacklisting and serious failures can lead to compensation for moral damages, and many consumer lawsuits go through the Small Claims Courts, which generally charge no costs at first instance. We run the numbers with you, frankly.
How long do I have to complain?
It depends on the problem: defects in products and services have short deadlines (generally 30 or 90 days from delivery or from when the defect appears), while compensation for damage caused by a product or service generally expires after 5 years. So the sooner the review, the better.
What evidence should I keep?
Anything documenting the relationship and the problem: screenshots of conversations and ads, ticket numbers, invoices, proof of payment, statements, emails and photos or videos of the defect. Writing down the ticket number of each call makes a difference.
I already complained to Procon and it wasn't resolved. What now?
A Procon complaint is useful and becomes evidence, but it neither prevents nor replaces a lawsuit. If the company did not solve it, the next step is the courts, and the complaint history strengthens your case.
