Those who worked exposed to noise, chemical agents, electricity or other risks may be entitled to count that time more favorably. Documents such as the PPP and the company's technical reports help prove special activity.

An INSS denial is not the final word. Denied disability benefit, retirement or BPC claims can be reviewed, with new documents, an appeal to the INSS or a lawsuit, depending on the case.

Frequently asked questions about the INSS

The INSS denied my claim. What can I do?

After a denial, you can appeal to the INSS itself, generally within 30 days of learning of the decision, file a new application with additional documents, or take the case to court. The best path depends on the reason for the denial, so it is worth sending the INSS decision letter for review.

Who is entitled to BPC/LOAS?

The BPC is an assistance benefit of one minimum wage for elderly people aged 65 or over, or for people with disabilities, in low-income situations. The law uses as a reference a family income per person of up to 1/4 of the minimum wage, and the family must be registered with up-to-date data in the CadÚnico. In some situations other factors are considered, so each case deserves review.

Do I need a lawyer to apply for an INSS benefit?

It is not mandatory: the insured person can apply on Meu INSS. Professional guidance helps choose the most favorable benefit and rule, gather the right evidence and avoid denials for missing documents, and it makes a difference when the case needs to go to court.

Do I need to go to the office?

What documents will I need?

Is there a deadline to review or challenge a benefit?

Yes. As a rule, a benefit review must be requested within 10 years, counted from the month after the first payment (art. 103 of Law 8.213/91). Other requests and lawsuits also have their own deadlines. So if you suspect a calculation error or had a claim denied, it is worth assessing as soon as possible.

Is my data protected?
