Bad harvest, tight debt

Crop leases, pasture rentals and partnerships are valid even when verbal, but without a written contract they become a source of conflict: minimum terms, renewal, right of first refusal and division of production have legal rules that many people only discover in a dispute. Setting the price in sacks of grain also requires careful drafting. Putting it on paper protects both parties.

When the harvest fails and the credit notes fall due, acting before enforcement widens the options: extension, rescheduling, review of guarantees and, in more serious situations, judicial reorganization, which the law also allows for individual producers who meet the requirements. In 2026, Provision 216 of the National Justice Inspectorate standardized parameters for these requests.

Small family property

Tractors and harvesters financed with the machine itself as collateral can be quickly repossessed when installments fall behind. There are defenses and ways to negotiate, but the reaction time is short: once the notice arrives, every day counts to keep the machine working.

The Constitution protects small family-worked rural property from seizure, and the STF has recognized this protection even when the property was given as collateral. For those who live from what they grow, this defense can be decisive.

Frequently asked questions about agribusiness law

Do you serve individual producers and rural companies?

Yes, both. From family farmers to groups with several properties and companies, what changes is the recommended structure, including the comparison between keeping the activity as an individual or organizing it as a company.

Does digital service work for those on the farm?

Yes: everything is handled via WhatsApp and video calls, with documents photographed on your phone, without you having to leave the property on a working day. In-person visits, when needed, are arranged case by case.

My lease is only verbal. Is it valid?

Yes, and rural law applies even without paperwork, including on terms and right of first refusal. The problem is proof: without a written contract, each side tells a different version. Formalizing it works both for a new deal and to settle a dispute over an old one.

I'm struggling with my bank credit notes. When should I seek guidance?

Before they fall due, whenever possible. With time there are more alternatives: renegotiating, rescheduling, reviewing guarantees. Once the bank goes to court there are still defenses, but options narrow and costs rise.

How are fees charged?

Depending on the matter: one-off work has a fixed fee; collections may combine a fixed fee with a success percentage; and properties with constant needs have ongoing advice. In all cases, the proposal comes in writing before any engagement.
