When leaving a job, it is common for amounts to be missing or miscalculated: salary balance, notice, vacation with the one-third bonus, proportional 13th salary, FGTS with the 40% fine. The termination statement and payslips let you check each amount.

Accident and illness

When there is a boss, fixed hours, personal work and a salary disguised as an invoice, hiring as a contractor may hide an employment relationship, with the right to a registered work card and all amounts for the whole period, subject to legal deadlines.

Workplace accidents and work-related illness can lead to job security after returning, compensation and effects with the INSS. The accident report (CAT) and medical documents are the starting point of the review.

Frequently asked questions about labor rights

How long do I have to file the lawsuit?

As a rule, the deadline is 2 years from the end of the contract, and the lawsuit covers rights from the last 5 years. So those who left their job recently have a window that does not come back: the sooner the review, the more rights remain within the deadline.

I am still employed. Can I claim my rights?

Yes, and in some situations it makes sense to act while still employed, as in constructive dismissal or harassment cases. In others, the strategy recommends waiting. This is assessed case by case, always confidentially: the company does not find out about the consultation.

What evidence do I need?

Very helpful: work card, payslips, termination statement, FGTS statement, time records, schedules, work messages and names of possible witnesses. But don't give up for lack of paperwork: several documents must be presented by the company in the lawsuit.

How much does it cost to file the lawsuit?

Will I need to attend hearings?
