Straight answer

When can child or spousal support be reviewed?

When the financial situation of the payer or the recipient changes after the support was set. Job loss, lower income, the birth of another child or illness may justify a reduction. Higher income for the payer, new expenses for the child, school or health treatment may justify an increase. Until there is a new decision, the old amount remains due.

What the law says

Key points

Relocation

You must prove that the situation changed after the decision or the agreement.

Need and ability to pay

The new amount considers the expenses of the person receiving and the income of the person paying.

Current amount

It remains due until the new decision. Stopping payment creates a debt.

Agreement

Father and mother can reach an agreement and ask for court approval.

Common questions

Frequently asked questions

Can I reduce the support on my own?

No. Only the judge or a court-approved agreement can change the amount. Paying less creates a debt and can lead to jail.

Does unemployment automatically reduce child support?

No. A review must be requested in the courts.

Does a new child reduce child support?

It may justify the request, but it does not reduce it automatically.

How long does it take?

It depends on the court and on whether there is an agreement. The judge may set a provisional amount at the start.

Do you serve clients outside Anápolis?

Yes. Service is provided at the firm's office in Anápolis, or online for all of Goiás and other states.

How much does it cost?

After the analysis, the firm sends a written fee proposal before any engagement.
