Who can get a divorce at a notary office?

A couple who agree on the divorce, the division of property and spousal support can divorce by public deed at a notary office (cartório), with a lawyer. Since 2024, a CNJ resolution allows divorce at a notary office even with minor or incapacitated children, as long as custody, visitation and child support have already been settled in the courts. A pregnant woman cannot divorce at a notary office.
