What to do when the debtor does not pay the judgment amount?

The creditor files for enforcement of the judgment, and the debtor is notified to pay within 15 days. Without payment, a 10% fine and 10% legal fees are added, and asset freezes begin. The decision can also be protested at a notary office (cartório) and the debtor's name can be added to bad debtor lists by court order. When the usual means fail, the judge may adopt atypical measures, such as suspending the driver's license (CNH), passport or cards, in a reasoned, proportional and subsidiary way, as the STJ held in Theme 1,137 in 2026.

Do I need a new case?

No. Enforcement takes place in the same case as the judgment.

Can the judge suspend the debtor's driver's license (CNH)?

It can, as an atypical and subsidiary measure, with proper reasoning and proportionality, according to the STF and the STJ.

What if the debtor has nothing?

The case may be suspended, with new searches carried out periodically. Attention is needed to intercurrent statute of limitations.

Does the firm have direct access to the court systems?

No. Official systems such as Sisbajud, Renajud, Infojud and Sniper are triggered by the judge at the lawyer's request. The firm uses its own systems and public databases, in compliance with the LGPD, to search for assets and point out to the court where they are.
